THE STATEMENT CASE FOR PRISONERS OF WAR..................................1 to 374 THE ATTACHMENT...............................................................................................375 QUESTION/ PRESENED I. How does he exactly take cognizance about to super legalistic values of the United States Treaties and International Agreements of the United States of America and the Republic of Vietnam to have solemnly declared in the protocols international relations when the proxy war of America’s fighting against communism to take place in South Vietnam? II. What did his family and he grant for a livelihood when the Government of the United States of America has left him on the battlefield of the Vietnam War without had regrets? III. How somehow does he firmly respectfully protect the statutorily of the United States of America to let us understand about the burden of sufferings and unluckiness of the plaintiff- family — even though, his human dignity was humiliated by his allied partnership and to what masterminded the American leaders of the Vietnam War had self- confessed doing wrongful action in themselves? IV. Whether the United States of America expresses exactly the righteousness, the human rights, the ethics, and the equality of the US Constitution, if not, the Justice of the arrogance of negligence of undisciplined soldier of bankruptcy, and of the United States in the Vietnam War of prisoner of war for what is means? THE UNITED STATES OF AMERICA Parties REASONS FOR GRANTING THE WRIT This United States Senate should grant a writ of certiorari to review the question presented for several important reasons. The core issue presented here, whether the Federal Tort Claims Act’s 28 US Code§ 1346b- June 25,1948-Chapter 171-Tort Claims Procedure-mandatory administrative claim process set forth by Congress as a prerequisite to filing a lawsuit under the Act presents a state statute of repose which curtail the time in which a claimant must file a lawsuit in the United States Senate has divided the lower federal courts on several fronts. The answer to this question is an important federal issue over which the lower federal courts are now divided. The resolution of the issue by the United States Congress is why Congress has discriminated against the national color skin-in the meanwhile, the American leaders of the Vietnam War's masterminds have openly confessed the wrongful actions in the Vietnam War themselves by the written evidence solemnly declared. In fact, General Westmoreland, Secretary of state Henry Kissinger, and Lieutenant John Kerry are exact witnesses to the settlement case of prisoners of war during they have testified before the United States Congress which is why the righteousness of a superpower and modern civilization of the United States of America has not approved for the just cause of the Vietnam War. Therefore, the United States Senate not only protected the super values of the American peoples but also highly respected American honor and heroism again that reasons for the plaintiff petition with the United States Senate. Just because the unrighteousness of a superpower and modern civilization has not respected any just-cause, this great power will not exist for the long run worldwide. In fact, they have self-confessed wrongful war’s actions in the Republic of Vietnam while they have written evidence openly themselves-and therefore, the settlement case of the prisoners of war of the plaintiff has exactly with a legal action the right which is why the United States Congress has not resolved it, but the United States Congress had self-walked against on the law and Constitution. INTRODUCTION He would like to self-introduce you as an ex- Lieutenant Police Chief of a less developed village in a poor district in Quang Ngai Province of the Republic of Vietnam. When he and his all-fellow disciples, side by side together with the American Armed Forces, bravely fought against communism, it not only deprived us of the rights to live, but also threatened the security of the greatest power, modern civilized, and progressive American society. Just because we the Vietnamese policemen did not only strongly express interest in the enlightenment in democracy, the greatest power, the most modern civilized, and the richest system of the United States of America but also believed in the good heart of full humanistic Native Americans. Significantly, we hopefully have a dream looked like the Native Americans who are enrichments boundless as the happy families, as the American erudition writers, as the moral scientist, and so many conscience pundits that they are fully kindhearted and so much of patriotic politicians that they are very proud of the heroism of the Greatest Power and modern civilizations mean we have entirely listened the pursuant to the US policy. Let us together fight against communism when we have all forgotten the burdens of suffering. Even very good, the American Armed Forces were not hesitant for the far way when the United States and the Republic of Vietnam had the distance for half of the earth, but the American Armed Forces respect the super valued ideology of freedom, democracy, and equality to fight to protect for justice as Americanism. In condition, he should express his personality to his American allies to respect some of the super values of the United States. Let him be proportional with modern civilization when he esteemed his second motherland. He keeps up the good work when he has especially tried to create a doctrine called Noble True. He would like to solemnly introduce it to you. He would like to self-introduce to Sir that has thought about the American law, which is “Unmitigated punishment for offenders.” Even so good, he is a virtuous Vietnamese American artist, sculptor, and writer, and prisoner of war who creates a Noble True Doctrine that is called Noble Paths and Five Right Ways in which are Happiness, Source of Life and Sorrow (distress), and Five Right Ways are Right Thoughtfulness, Right Love, Right, Forgiveness, Right Struggle, and Right Independence. These are so-called surveying compasses to push him to the orientation of one’s purpose of the true value of one's life. Because he always highly esteems the good, the true, and the beautiful, and then, he must be able to donate part of the rest of his life to mankind because its happiness looked like his own. Its source of life is as important as his life and its sorrow looked like his own. His Five Right Ways: The Right Thoughtfulness, the Right Love, the Right Forgiveness, these belong to the ethical conduct of his heart; the Right Struggle and the Right Independence has belonged to mental discipline or so-called wisdom. The Vietnam War has taken a place from China and Russia, France, and the proxy war of America did not only have the whole Vietnamese people who have the biggest burden of suffering but also had offered his family and him to be a war victim of them for the long run by the barbarous wars. Therefore, he composes this doctrine to remind many American leaderships on the Vietnam War and the worldwide leaderships that they should transfer wars to peace - even good; the formal principle of justice of impression should enforce the law if the law is distorted by the powerful, so we, the Vietnamese American’s prisoner of war, must be struggled for Justice without having had fearless and animosity when buries the hatchet because the Government of the United States of America speaks one way, act another. In contrast, his Noble True is antipodal for the sick who are fighting against the social society, so most of them are belligerent men when they take the inhuman wars that look like their pleasures as Satan Association. For example, the sick hate the happiness of humankind, of the innocent men, and the lack of respect for others. Significantly, the sick's against to social is the same as selfish because it has not respected and the beautiful, the true, and the good or so-called are the same as racism because it does think other national color skin such as animal-cattle-and therefore, it wishes to deprive of the rights to life of another racist In conclusion, the sick against society have never wished other races to have a little happiness and a little enrichment, but the sick against social wishes to exploit the blood-bones of humans. Therefore, the sickness against society is under the mask of belligerence, invasion, and deprivation of the rights to life of less modern civilization than the sick. However, the sick has never had to improve oneself, correct oneself, and perfect oneself. Let us protect the super values of the United States Constitution and American justice because the United States of America is his second fatherland while the Government of the United States of America carried out the Vietnam War by the written laws which is why the United States Congress has self-torn shreds them and the Government of the United States of America is too. Second, he would think about the American law which has been equally enacted by the United States Congress. However, a few American leaders have distorted the American law for the Prisoner of war of the Vietnam War. Let them push the Vietnam War of the proxy war of the United States of America to the inhuman war. Even worse, when they were arrogant, they did not only have contemptuously of public opinion of our worldwide but also held in contempt for the Republic of Vietnam and the Southern people that we are very stupid to not understanding about the United States Constitution and the American law when the United States Congress enacted. In deeply, the Republic of Vietnam of us that the Government of The United States of America did not only respect our self-determination by the United States Treaties which were to be the International Agreements but also had the United States Congress enacting for statutorily and had solemnly declared by the protocols of the international relations of both nations. Significantly increased, all the super values of the United States Constitution, the American law, and the United States Congress has been cast into statutorily of the Vietnam War of the proxy war of the United States of America when the government of the United States of America has formatted the Vietnam War by the proxy war of America which is why the American leaders and the government employees had violated statutorily. In fact, the Government of the United States of America did not only keep the promises of their proxy war to perform the Republic of Vietnam but also had torn shred statutorily and all the United States treaties and the International Agreements of the Vietnam War. Especially, the International Convention for Prisoner of War did not only approve by the Government of The United States of America but also had the United States Congress enacting statutorily for its own law of prisoner of war which is why the prisoner of war of the Vietnam War of the Southern Officers did not enforce by the American Government. Finally, he is not having any powers when his hands are unarmed, but his brain, his mind, and his young mindset are realized where is wrong and right or correct and not correct of the American law of the Vietnam War of prisoner of war by his own knowledge, and therefore, he does believe the United States Senate has enacted as exactly. H.R. 309 recognizing the fall of the Republic of Vietnam on 30 April 1975 and [USC02] 5 USC 702: s code.house.gov. Right of review. Indeed, the masterminds of the Vietnam War of the proxy war of the Government of the United States of America were self-confessed wrongful actions while the written evidence of the American Leaders' masterminds of the Vietnam War had belonged to the American defendant’s self-confession. Therefore, according to a lawsuit action is adequately legal, which is why he would like to ask for the United States Senate to keep the oath of allegiance with the United States Constitution. Why didn’t the Government of the United States of America compensate any benefit-pennies of his prisoner of war? In comparison, the Government of the United States of America is richer than him by a trillion-fold, that is why the USA does think that his life is less valued than the American cattle. Therefore, he would introduce his doctrine as Noble True. As a result, no child, and no parents of the American leadership were killed by the Vietnam War when they were insensitive to the Southern Officers’ prisoners of war. In fact, so many of the American leaderships have not justifiably considered the settlement case of the prisoners of war when they built up the Vietnam War themselves. Just because they have protected their core of interests, they trampled the core of interest of the Vietnamese- American minority ethnic group living together with the American indigenous peoples down. In conclusion, the people who live in the modern civilized and progressive American society whenever the American citizens always express themselves such as the Army and people like fish and water. Thus, the use of the law of the government of the United States of America goes not against justice to mistreat its people, so the law is not demagogy. While the nation will not take place chaotic because justice is respected by all people. Significantly, the law does not only rule its citizens but also protects justice and equality without having discriminated against any national color skins and people who live anywhere on the earth. Therefore, the American Government always expresses the justice cause of each immigration ethics lives together with American indigenous peoples because the US Constitution has declared and said, “All men are created equal.” Because the American law and the United States Constitution have not discriminated against everyone who lives in the world and special person’s living in the United States of America currently. Just because the United States Congress has not prejudiced any national-colored sources, which is why his settlement case’s prisoners of war were denied from the local courts to the United States Congress by their insensitivities. On the other hand, why did they understand to self-realize for what the United States did Congress enact the law to seize his sacred nation? Why do they deprive them of the rights to life of his fellows and his innocent Vietnamese people without having compensated any pennies? In the meanwhile, the United States Congress has enacted a law to compensate for the prisoners of war of the Vietnam War, but H.R 309 is to be nothing. Therefore, Bright Quang has been manipulating for all his young mindset by his heart and brain to study the American laws which were related with the Vietnam War and all of multilateral, bilateral treaties, and the international relations of protocols between the Republic of Vietnam and the American Government and included the Hague Convention. Let his petition with the United States Senate to seek justice as a prisoner of war without having any political motive secretly promoted him. PROPSOSAL FOR HEARINGS & MEETINGS To: Honorable Senate Chairwoman Harris, Kamala D. United States Senate – 117th Congress Washington, D.C. 20510 - Honorable Senate Democratic Leader Chairman of the Conference Schumer, Charles E.(D-NY) - Honorable U.S. Senators: Office of Senator Schumer, Charles United States Senate- Washington, D.C. 20510 322 Hart Senate Office Building, Washington DC 20510 - Honorable Senate Republican Leader McConnell, Mitch(R-KY) For Correspondence to U.S. Senators: Office of Senator McConnell, Mitch, United States Senate-Washington, D.C. 20510317 Russell Senate Office Building Washington, DC 20510 - Honorable Senate Chairman Committees Armed Services Jack Reed (D - RI) Correspondence to Senate Committees: (Jack Reed (D - RI)) United States Senate, Washington, D.C. 20510 - Honorable Senate Chairman Committees Foreign Relations Bob Menendez 423 Dirksen Senate Office Building · Washington, DC 20510-6225 - Honorable Senate Chairman Committees on the Judiciary Dick Durbin of Illinois 224 Dirksen Senate Office Building Washington, DC 20510 - Honorable Senate Chairman Committees on Ethics Christopher A. Coons 220 Hart Building, United States Senate, Washington, DC 20510 Dear Senate Chairmen Committee’s sir First, exact self-evident- truths of the proxy war America are enforced by the justice of the American laws and the United States Constitution, which is why the United States Congress has not carried out the compensation of the Southern Officers of prisoners of war and therefore, he would like to be a proposal for Hearings & Meetings to request the compensation of the prisoners of war without having had any motive politics. Good even, exact the US Congress has been enacting for the laws and the US Constitution for being approved multilateral and bilateral treaties, and the international relations of protocols with the Republic of Vietnam to approve the sovereignty and the self-determination of the Republic of Vietnam from December 23, 1950, by 22US Code §§1571_1604, which is why the US Congress does not enforce this multilateral treaty with the Republic of Vietnam. Exactly, the written rules of the Government of the United States of America’s Agreement effected by exchange of notes Signed at Saigon April 4, 1961: Entered into force April 4, 1961, by Embassy of the United States of America, Saigon, and April 1961. Number152-TIAS 4717 Second, the US Congress has enacted this law when the US Congress has declared to increase the understanding between the Government of the United States of America and other nations that’ mutual understanding between the people of the United States and the people of other countries by means of educational and cultural exchange; to strengthen the ties which unite us with other nations by demonstrating the educational and cultural interests, developments, and achievements of the people of the United States and other nations, and the contributions being made toward a peaceful and more fruitful life for people throughout the world; to promote international cooperation for educational and cultural advancement; and thus to assist in the development of friendly, sympathetic, and peaceful relations between the United States and the other countries of the world. Which is why the US Congress has said one road did another? For example, President Kennedy has secretly ordered his Central Intelligence Agency (CIA) to not only assassinate President Ngo Dinh Diem but also destroy the Republic of Vietnam allied with the United States of America. In the meanwhile, President Kennedy and President Ngo Dinh Diem together had worship one God, they are eating one Holy Cake and drinking Holy Water which is an American President Empire has assassinated a weaker Vietnamese President when they are allied by multilateral treaties and international relations of protocols. How do we realize about the American law and the United States Constitution because the Four Amendment has not allowed any American leadership who self-deprived of the rights to life of the American allied as the Republic of Vietnam? Third, how would exactly the United States treaties and the American laws, and the United States Constitution of the Foreign Relations enforce the Proxy war in the Republic of Vietnam? That is why all multilateral, bilateral treaties, and in the international relations of protocols of the United States signed with the Government of the Republic of Vietnam to be unjust laws of the United States Congress? In fact, the United States Department of Defense Law of War has exactly been enacting the written rules, but they have not been enforced for the Vietnam War? How would the United States Congress think oneself about the greatest power, modern civilized and progressive America’s Age to deceive the Southern Officers’ prisoners of war? To prove, the United States Congress has exactly been enacting many laws of the settlement case’s prisoners of war which are to be the unjust laws. For example, 50 USC§ 4105 Prisoners of War-June24, 1970, 50 USC§4101 (a)(b)(c) Foreign Claims Settlement Commission of the United States; June 3,1948 and 28 US C§ 1346b – June 25, 1948-Chapter 171-TortClaims Procedure, which are: § 2671, §2672, § 2673, §2674, §2675, §2676, §2677, §2678, §2679, and §2680 and especially 22 US C § 1622a -US Code-Un-annotated Title 22. Transfer of Foreign Claims Settlement Commission of the United States to Department of Justice in which are: § 1622b, §1622c, §1622d, §1622e, §1622f, §1662g Please review his settlement case for Prisoner of war. In condition, the United States Congress enacted a few of especial laws which are HR, 7885 Pub-L88-205, which is why the US Congress has only enforced for the invaded war to deprive of our rights to life us, but the US Congress has not considered to our human-rights when the US Congress has approved this Human Rights Treaties. That is why the United States Congress is represented by the greatest power, modern civilized, and progressive America’s Empire when the United States Congress does not only trample humankind down but also deprives the rights to life of our Vietnamese to let the USA protect the core of interests of America. Whereas, the United States Congress has freely deprived the rights to life without having had regrets, Article 1 of the United Nations has declared and said, “All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.” So, the United States of America is one of the national Empires that approved this treaty. In the meanwhile, the US Congress has enacted. H.Res 309 recognizing the fall of Saigon on 30 April 1975which is why the US Congress has not compensated any prisoners of war dangers to us when the US Congress is violated10 US, Code § 273 -Aug. 10, 1956 because the US Congress enacted H.R 7885 to allow the American Armed Forces invaded to the Republic of Vietnam. Fourth, for the US Congress has understood about Department of Defense Law of War manual than him Good even, the United States-Department of Defense Law of War Manual does not only have perfectly but also represents the super values of the greatest power and modern civilization by the playing yard of war is very equal which is why the United States Congress has been fooling for weak prisoners of war when the US Congress has used the law and Constitutional rights in order to deceive a less education and less development for a Vietnamese people racism. Please review your Department of Defense Law of War manual when he has cited some Articles which have related to the Vietnam War and prisoners of war, let him prove exact laws with the US Congress that H.R 309 Recognizing the fall of Saigon on April 30, 1975, which is the US Congress is easily enacting HR.7885 to rob the Republic of Vietnam after the thirty years in the wars. The American Armed Forces are freely destroyed his nation, his innocent Vietnamese people, and his honest family and his private body have been bringing the burden of sufferings of the United States Congress of the proxy war when the United States Congress has gradually exchanged us to be the animal-cattle of the United States Congress without having had any humanities. Significantly, the United States Congress has not enforced the Geneva Conference on 20 What does he somehow understand about the Rule of law or the rule by the law of the government of the United States of America because Distort justice is a national traitor? On July 20, 1954, to bully our people to make an enslaved war of the United States of America without having paid for prisoners of war, Let the United States Congress conquer us to fight against socialism because the United States has not enforced the Geneva Conference for Vietnam. In the end, the United States Congress has self-torn shreds all the sublime law and Constitution, and multilateral, bilateral treaties, and the international Relations of protocols with the Republic of Vietnam. Let the United States Congress sell all-natural resources and human Vietnamese to communism. Why would have the US Congress treat us to be lower less than the animal-castle-Americans? Finally, the righteousness of a lawsuit must have the truth justice when he has collected all the details of the American masterminds of the proxy war America in the Vietnam War. Let him submit for proposal for Hearings & Meetings when he has had all-self-evident truths by the mouths of the Americana leaders have been sprayed by their arrogant ignorance of the greatest power and modern civilized and progressive American Empire by their self-confessed oneself. In fact, the US Congress has approved multilateral Treaties by 22 US Code §§ 1571-1604. Pub-L329-81 St Congress, 63 Stat. December 23, 1950, and there, and President Kennedy sent the American Armed Forces to seize the Republic of Vietnam. Moreover, President Johnson has recalled. General Westmoreland who was fighting against communism in the Republic of Vietnam battles when he returned to testify before the United States Congress as he said “Westmoreland’s designation as the president’s chief surrogate in the spring of 1967, though, left little doubt that Johnson had committed himself, and the nation, to continued war. Johnson intended his “salesmanship campaign” to shore up defenses backing the United States’ commitment to Vietnam, to push back against those questioning the viability of his policies. The nation’s top field general would disprove critics by demonstrating progress. Therefore, General Westmoreland has represented by the justice of the United States, he said, “At Westmoreland’s first stop, The Associated Press’s annual editors’ luncheon on April 25, the general argued that Vietnam’s fate would affect the future of all “emerging nations.” He lauded his soldiers ‘performance in rescuing a Saigon government “on the verge of defeat,” while highlighting the complexities of this kind of war — “a war of both subversion and invasion, a war in which political and psychological factors are of such consequence.” And while a confident Westmoreland painted a favorable military picture, he twice emphasized a point that most likely made Johnson wince. “I do not see any end of the war in sight.” In condition, when he self-confessed and declared, “On behalf of the United States Army, I apologize to the South Vietnamese Army veterans because we have abandoned you.” On behalf of the United States Armed Forces, I would like to apologize to the veterans of the South Armed Forces for abandoning you guys.” Therefore, Mr. Bright Quang, he has had the self-evident truth when he would like to submit to the United States Senate to review his settlement case of prisoners of war. Originally published September 30, 2010, at 12:00 a.m. Updated September 30, 2010, at 8:25 am. What does he somehow understand about the Rule of law or rule by the law of the government of the United States of America because Distort justice is a national traitor? Fifth, special Vice American President Agnew did not only confirm that the involvement of the United States in the Vietnam War is heroism but also Agnew has represented by the United States Senate chairman when he was the retrospective view of American history which was the war not only spend costly mistake but also US Senate Chairman has a viewpoint his objectiveness that the Vietnam War was very moral; which is why the US senate Chairman imprisoned one million soldiers of the Republic of Vietnam without having compensated for us to express modern civilization and morality. Whether imprisoned one million soldiers of American allies have expressed the high values of moral that is why the greatest Power America has self-destroyed one legal Government of the Republic of Vietnam which is just close American allied to express heroism when the US Senate Chairman said: SEQ. 5: AGNEW: "There's been a strong effort in America to portray our involvement in Vietnam as a great and costly mistake. Only the retrospective view of history will tell whether it was, or it was not. But beyond doubt, after agonizing deliberation, it has been the considered policy of four consecutive presidents from both political parties. I believe history will record that as a very worthwhile and a very moral accomplishment, perhaps the most moral act the United States has ever performed as a citizen of the world community. And that is my answer to those who say that this is an immoral war." Despite, Secretary of state Kissinger: Vietnam failures `we did to ourselves.’ Henry Kissinger, who helped steer Vietnam policy during the war's darkest years, said Wednesday he is convinced that “most of what went wrong in Vietnam we did to ourselves" - beginning with underestimating the tenacity of North Vietnamese leaders. Therefore, Secretary of state Kissinger has arrogantly declared and said, “The Vietnam War requested us to emphasize the national interests rather than abstract principles. What President Nixon and I tried to do was unnatural. And that is why we didn’t make it” is Secretary of state Kissinger has self-confessed his betrayal oath of loyalty when he was nominated Secretary of state by the Constitutional rights. Especially, Lieutenant John Kerry has an especial witness for the Bright Quang case because John Kerry does not only have a Native American but also has to attend in the Vietnam War when he said,” Vietnam Veterans Against the War Statement by John Kerry to the Senate Committee of Foreign Relations April 23, 1971I would like to talk on behalf of all those veterans and say that several months ago in Detroit we had an investigation at which over 150 honorably discharged, and many very highly decorated, veterans testified to war crimes committed in Southeast Asia. These were not isolated incidents, but crimes committed on a day-to-day basis with the full awareness of officers at all levels of command. It is impossible to describe to you exactly what did happen in Detroit - the emotions in the room and the feelings of the men who were reliving their experiences in Vietnam. They relived the absolute horror of what this country, in a sense, made them do. Besides that, former President Bush's son defamed us when he declared on the American public Media and said, "South Vietnam did not fight for the freedom which is why they did not have it today." Whereas he is an American President did not compensate for the prisoners of war for the Sothern officers of prisoners of war because the Vietnam War was built up by the Government of the United States of America, not only violated the United States Constitution but also prejudiced the American law for the Vietnamese minority ethnical lives together with American indigenous peoples by the American discrimination because the United States seized his nation, the Government of the United States of America sold our sovereignty to socialism. As a result, the Paris Peace Accords of the Vietnam War has not had any chapters and Articles which allowed the United States Congress to not only imprison any Southern officers but also have the right to sell the Republic of Vietnam to communism. Just because, the discrimination national color origin of the United States Congress has prejudiced with the Vietnamese allied of the United States or the Asian yellow skin is discriminated by the American superpower, which is why the Native Americans were compensated the lost properties by the proxy war America, but his property, his merits, and his intellectual property were equally compensated by the Government of the United States. To prove, the Native Americans were compensated by this case: Number of Claims 534 Number of Awards 192 Amount of Awards - Principal $99,471,983.51 Amount of Fund $203,504,248 Amount of Payment $100% of Principal plus 80.3%of Interest But he is the Vietnamese yellow skin that is discriminated by the American must-power; he, therefore, has collected the self-evident truths. He would like to submit to the United States Senate to review his settlement case of prisoners of war without having had any motive politics. Let him would be proposed for Hearings and Meetings with the United States Senate to point out many mistakes of the United States Congress that have been fooling him and his Vietnamese people and especially to his sacred nation. Because no parents of the whole world were born the children who had serviced for the American wars, but they did not compensate the benefits of prisoners of war as the United States Congress. THE FEDERAL STATUTORY PROSISION, THE UNITED STATES CONSTITUTION, AND THE HAGUE CONVENTION, AND INTERNATIONAL LAW, AND MULTILATERAL & BILATERAL TREATIES, AND INTERNATIONAL RELATIONS OF PROTOCOLS, AND INDIGENOUS RULES INVOLVED. page 1. 28 US.
